The home inspector did the right thing by leaving the property on Monday . . . without doing his job.
Hostile tenants, foreclosed property, my client under a 10-day home inspection contingency . . . oh what fun it is to be a real estate agent these days.
It's sad when tenants want to put the kibosh on things that are not in their control.
This is nothing new, and I even wrote a post about it (almost two years ago -- time flies) Hostile Tenants Putting the Kibosh on Your Listing?
While representing a buyer, I found a viable property. The buyer thought so too, so we wrote up the offer. It was accepted and then the 10-day inspection contingency started to run.
The home inspection was ordered, the tenants were notified with a 3 day head's up. When the home inspector showed up at the appointed time, he was greeted with:
"You only have 20 minutes"
According to the tenant, who stood with arms crossed and glaring eyes, he would only allow the home inspector 20 minutes to access the property.
A home inspection can't be done in 20 minutes. I mean, not a good one. There's protocol, state mandates on what needs to be inspected, procedures to follow . . . the standard of practice, as it were. The home inspector wasn't going to be limited in this way by the tenant. He knew he couldn't complete a thorough home inspection in 20 minutes . . . can we say liability boys and girls?!? So, he did what he could do . . . he left!
As it stands, the inspection will take place . . . after the tenants are gone.

Amazing. Hope those tenants leave very soon. What knuckleheads. That is a very good home inspector...some may have done the crazy 20 minute inspection!
Good luck with your buyers Carla. I agree that the inspector did the right thing. I am in a similar situation with one of my listings with a hostile tenant. We'll see how that goes.

Hey Brenda -- even more knuckleheadish was the comments the tenant made to not only the inspector, but the listing agent. The tenant told both of them he was going to rip out the kitchen counter tops, etc. Quite hostile.

I really try to make the best of a situation when I'm hired but there is only so much that can be done. Most of the time things go pretty smooth but I agree with the Inspector where this is one of those situations where you have to leave. I feel bad for the Inspector because these vistis usually cost them money. The home inspector should still be paid for the time he was there but it rarely happens.
Ahhh, the dreaded hostile tenant. Were they there for the showing? I have had a couple that were so openly hostile that we never got past the front door. Good luck with this one

Like the tenants had any real legal say in the matter. We should start fining these guys & I bet it would stop - like loose 50% of your security deposit if you don't allow access to a home you don't own?
we waited until we got tenants out with cash for keys before we even marketed a foreclosure. they were also threatening to take 'things' light fixtures, matching refrigerator ect..
I'm sure we all have our horror tenants stories but this one is pretty bad. Kudos to you and the inspector!
Tenants have become the bane of a lot of Realtor's existances. Sorry it keeps happening to you.
Carla ~ a foreclosed home had tenants in it? Yikes! That tenant sounds like a real ---. I'm glad you were able to get an extension.
Carla...glad you were able to extend the contingency period! I also hope the buyer doesn't get charged for the inspection that could not be performed.
Wow, that is unbelievable. Sounds like the home inpsector acted honorably and based on some of your above comments sounds like the inspection must be done after they leave anyway to make sure nothing else is missing or damaged. wow.
Hi Robert . . . the inspector gets a lot of my referrals, so in the 12+ years of association I don't think he really cares about a "fee"

Hey Dawn -- they SQUATTED after the home owner lost their property. They didn't pay rent for months and squatted.
Hi Christine . . . no, there's no fee. It wasn't my clients fault the inspector couldn't access. Buyer and Seller want to close escrow. Hostile squatter tenants are taking a dump on the deal and acting like babies. They couldn't qualify to buy the home, so they want to make everyone else miserable. It'll work out.
Hey Debbie -- Yes, we've got the inspection contingency amended. People are SO STUPID when they want they want their cake and eat it too. LOL
